Terms & Conditions - TOBAR

1. Services Offered
1.1 Scope of Services
TOBAR provides the following services:

3D Images - High-quality visual representations of architectural projects.

3D Videos - Animated walkthroughs or sun studies to explore spaces dynamically.

3D Printed Models - Scaled physical models of designs.

Design & Planning - Residential architectural design and planning support.

1.2 Deliverables
The details of each project, including the number and type of visuals, timelines, and file formats, will be outlined in writing before work begins.

2. Client Responsibilities
2.1 Project Information
Clients are expected to provide:

Accurate plans, sketches, or reference materials

Clear goals and design intent

Reasonable deadlines

2.2 Communication & Feedback
Timely feedback and approvals help keep your project on schedule. If there are delays in client responses, project timelines may shift.

3. Payment Terms
3.1 Pricing
Each project will be quoted individually based on size, complexity, and service type.

3.2 Payment Structure

Deposit: A deposit is required to secure your project and begin work.

Progress Payments: For larger or ongoing projects, milestone payments may apply.

Final Payment: Due before final delivery of files or models.

3.3 Late Payments
Final work will not be delivered until full payment is received. Work may be paused if payments are significantly delayed.

4. Intellectual Property
4.1 Ownership
TOBAR retains full rights to all visuals, models, and designs until payment is received in full.

4.2 Client Rights
Once full payment is made, the client receives a non-exclusive license to use the work for the intended project. Any reuse or resale must be agreed separately.

5. Confidentiality
Client information and materials are treated with discretion and used solely for completing the agreed project. We won’t share or publish your project without your permission.

6. Project Timelines & Delivery
6.1 Timeframes
Estimated delivery dates will be agreed in advance. Delays due to missing information or late feedback from the client will affect these timelines.

6.2 File & Model Delivery

Digital visuals are provided via email or shared link in JPG, PNG, or MP4 formats (or others by request).

Physical models can be collected or posted (postage fees apply).

7. Limits of Liability
While we do our best to deliver high-quality and accurate visuals, TOBAR is not responsible for how third parties interpret or use them. We're not liable for indirect or unforeseen issues arising from project use.

8. Force Majeure
TOBAR is not responsible for project delays or non-performance due to events beyond our control, including illness, technical failures, or natural disasters.

9. Project Termination
9.1 By the Client
You may cancel your project at any stage. Refunds are given for work not yet completed, less your deposit.

9.2 By TOBAR
We may cancel the agreement if terms aren’t followed (e.g., unpaid invoices or communication breakdowns). In that case, no further work will be provided.

10. Governing Law
These terms are governed by the laws of the Republic of Ireland.

11. Changes to Terms
We may update these terms occasionally. Significant changes will be communicated in writing.

12. Agreement
By commissioning work with TOBAR, you confirm that you’ve read and agreed to these terms.
